Terms of service
Last updated: 10/13/2026
1. Agreement to These Terms
These Terms of Service ("Terms") are a binding agreement between you and Horizon Motorsport Inc., a California corporation ("Horizon Motorsport," "we," "us"). They apply to your use of horizonmotorsport.com and any purchase you make from us online, by email, by phone or in person.
By placing an order, you confirm that you have read and agree to these Terms and to the policies listed in Section 2. If you do not agree, do not place an order or use the site. You must be at least 18 years old and legally able to enter a contract to purchase from us.
Section 17 requires most disputes to be resolved through individual binding arbitration and waives class actions and jury trials. Please read it.
2. Other Policies That Apply
The following policies are part of these Terms: our Refund Policy, Shipping Policy and Privacy Policy, plus any warranty terms shown on a product page. If one of those policies conflicts with these Terms on returns, cancellations, shipping or warranty, that policy controls for that topic. On everything else, these Terms control.
3. Orders and Acceptance
Your order is an offer to buy. A confirmation email means we received your order, not that we accepted it. We accept your order when we ship it.
We may refuse, limit or cancel any order, in whole or in part, at any time before shipment, including for suspected fraud, unverifiable payment or address details, quantity limits, pricing or listing errors, product unavailability, or an order we believe would violate Section 8. If we cancel after you have been charged, we will refund the amount charged for the cancelled items.
We may ask you to verify your billing address or other order details before we ship. If you do not respond within a reasonable time, we may cancel the order.
4. Prices, Errors and Payment
Prices are in US dollars and may change at any time before you order. Sales tax is added where required. International buyers pay all duties, import taxes and brokerage fees.
We work to keep product information, fitment and prices accurate, but errors happen. If a product is listed at an incorrect price or with incorrect information, we may cancel the order and refund you, or contact you to confirm the corrected price before shipping, even after you receive an order confirmation.
If you have a problem with a charge, contact us first at sales@horizonmotorsport.com. Our Refund Policy describes how we handle payment disputes and chargebacks.
5. Shipping, Title and Risk of Loss
Shipping times are estimates, not guarantees, and depend on stock, the manufacturer for items we do not stock, and the carrier. Title passes to you when we hand the order to the carrier. Risk of loss passes to you when the carrier confirms delivery to the address on your order. Details on lost, stolen and damaged shipments are in our Shipping Policy and Refund Policy.
6. Aftermarket Products, Fitment and Installation
We sell aftermarket automotive parts and accessories. Unless a listing clearly states that a part is a genuine OEM part, our products are not made, approved, endorsed or sponsored by BMW AG, BMW of North America, Toyota or any other vehicle manufacturer. Vehicle makes, model names and chassis codes are used only to describe compatibility. Names that include "Style" describe a general look and do not mean the product comes from, or is affiliated with, any other company.
Fitment information is provided as a guide. You are responsible for confirming that a part fits your specific vehicle, trim and bumper or body configuration before you buy, and for test fitting it before any permanent installation such as drilling, sanding, cutting, adhesive, paint or wrap. Contact us before installing if anything looks wrong. Products that have been modified or installed are handled under our Refund Policy.
We strongly recommend professional installation. Horizon Motorsport does not install parts and is not responsible for the quality of any installation performed by you or a third party. Hand finished materials such as carbon fiber can show small variations in weave, finish and color, and these are not defects.
Installing aftermarket parts can affect your vehicle's factory warranty coverage for related components, depending on your manufacturer and dealer. Check with them before installing if this matters to you.
7. Assumption of Risk
Performance and appearance modifications can change how a vehicle drives, handles, sounds and performs, and motorsport and track driving carry inherent risk of property damage, injury and death. To the extent permitted by law, you accept these risks when you choose to install and use the products you buy from us.
8. Legal Compliance, Emissions and California Restrictions
Vehicle laws differ by state and country, including laws on emissions, lighting, noise, window tint, ride height and vehicle inspection. You are responsible for knowing and following the laws that apply to your vehicle and where it is registered and operated.
Certain products are marked on their product page as NOT LEGAL FOR SALE OR USE IN CALIFORNIA because they have not been exempted by the California Air Resources Board (CARB). We do not sell those products for use on any vehicle registered or operated in California, we do not ship them to California addresses, and we do not offer them for local pickup. By ordering a restricted product, you confirm that you are not buying it for installation or use on a vehicle registered or operated in California, and that you will not resell, forward or reship it to California or to anyone for that purpose.
We may cancel any order that we reasonably believe is intended to get around these restrictions, including orders using freight forwarders or reshippers, and may refuse future orders from the same buyer. If you are a dealer, installer or reseller, you are responsible for complying with these restrictions in your own sales and installations.
9. Warranty
Some products include a written limited warranty, which is described on the product page or in our Refund Policy. That written warranty is the only warranty we give. Where a product carries a manufacturer's warranty, the manufacturer is responsible for it and we will help you submit the claim.
Where we provide a written warranty, any implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, are limited to the length of that written warranty. Some states do not allow limits on how long an implied warranty lasts, so this limit may not apply to you.
Unless a product page or written warranty says otherwise, warranties do not cover damage from installation, misuse, accidents, racing or track use, modification, normal wear, road debris, or improper care. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.
10. Limitation of Liability
To the fullest extent permitted by law:
(a) Horizon Motorsport is not liable for any indirect, incidental, special, consequential or punitive damages, including damage to your vehicle or other property, labor or installation costs, towing, rental vehicles, lost time, lost income or loss of use, arising out of or related to any product, its installation or use, or these Terms, even if we were told such damages were possible.
(b) Our total liability for any claim arising out of or related to a product or order will not exceed the amount you paid us for the product that gave rise to the claim.
These limits do not apply to liability that cannot be limited under applicable law, including liability for death or personal injury caused by our negligence, or for our fraud or willful misconduct. Some states do not allow the exclusion of incidental or consequential damages, so parts of this section may not apply to you.
11. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless Horizon Motorsport Inc. and its officers, directors, employees and contractors from any claims, losses, fines, penalties, damages and costs, including reasonable attorney fees, arising from (a) your installation, modification or use of any product, or installation by anyone you hire, (b) your violation of any law, including emissions, lighting and noise laws, (c) your resale, reshipment or distribution of any product, or (d) your breach of these Terms.
12. Intellectual Property and Content
The site content, including our text, product photography, graphics, logos and the Horizon Motorsport name and HM marks, belongs to Horizon Motorsport or its licensors. You may not copy, reproduce or reuse it for commercial purposes without our written permission. Third party trademarks shown on the site belong to their owners and are used only to identify compatibility or the brands we carry.
If you send us or publicly tag us in reviews, photos, videos or other content about our products, you give us a nonexclusive, royalty free, worldwide license to use, display and share that content, with or without your name, in connection with our business. You confirm you have the right to grant that license. You can ask us to stop using your content going forward by emailing us.
If you believe content on our site infringes your rights, email sales@horizonmotorsport.com with the details, and we will review it promptly.
13. Site Use
You agree not to use the site to break any law, interfere with its operation or security, scrape or harvest data, submit false information, impersonate anyone, or place orders on someone else's behalf without permission. We may suspend or end your access for violating these Terms.
Links to third party sites are provided for convenience. We are not responsible for their content or practices.
14. Communications
You agree that we may communicate with you electronically about your orders and account, and that electronic notices satisfy any requirement that notices be in writing. Marketing emails are sent only with your consent and you can unsubscribe at any time. Our Privacy Policy explains how we handle personal information.
15. Force Majeure
We are not responsible for delays or failures caused by events outside our reasonable control, including carrier or customs delays, supplier and manufacturing delays, natural disasters, labor disputes, government action, and outages of third party services.
16. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules, except that the Federal Arbitration Act governs Section 17. Any dispute that is not subject to arbitration will be brought only in the state or federal courts located in Orange County, California, and you and we consent to their jurisdiction.
17. Dispute Resolution, Arbitration and Class Action Waiver
(a) Informal resolution first. Before starting any claim, you and we agree to try to resolve it informally. The party with the claim must send a written notice describing the claim and the relief requested (for us, to sales@horizonmotorsport.com and 200 Technology Drive, Suite B, Irvine, CA 92618). Neither side may start arbitration or a lawsuit until 30 days after the notice is received.
(b) Binding individual arbitration. Any dispute arising out of or relating to these Terms, the site, or any product or order that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator may award any individual relief a court could award. Fees are paid as provided in those rules. Arbitration may be held by video or in Orange County, California, or in the county where you live.
(c) Exceptions. Either party may bring an individual claim in small claims court if it qualifies. Either party may seek relief in court for infringement or misuse of intellectual property. Claims for public injunctive relief, if any, will be decided by a court after the individual claims are arbitrated.
(d) Class action and jury waiver. You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. You and we each waive the right to a jury trial.
(e) Mass filings. If 25 or more similar arbitration demands are filed by or with the help of the same law firm or coordinated group, they will be administered in batches of up to 25, with one batch proceeding at a time and the others held in abeyance, and the parties agree to mediate in good faith before the next batch proceeds.
(f) Opt out. You may opt out of this Section 17 by emailing sales@horizonmotorsport.com within 30 days of your first purchase with your name, order number and a statement that you opt out of arbitration.
(g) Severability. If the class action waiver is found unenforceable for a claim, that claim will proceed in court and not in arbitration. If any other part of this Section 17 is found unenforceable, the rest of it still applies.
18. General Terms
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms. We may assign them to an affiliate or successor. These Terms, together with the policies in Section 2, are the entire agreement between you and us about their subject.
We may update these Terms by posting a new version with a new "Last updated" date. The version in effect when you place an order applies to that order. Changes to Section 17 will not apply to a dispute already noticed under Section 17(a).
